Fatal Horry County Crash: William McLean’s Estate Files Lawsuit Over Illegally Parked Tractor

HORRY COUNTY, SC – The estate of William McLean, who tragically died in a car crash earlier this year, has filed a lawsuit claiming that the accident was caused by an illegally parked tractor. This legal action has brought attention to safety practices and accountability in construction zones.

On Friday, the estate of William McLean filed a lawsuit against several parties: RCB Contractors, JJ Spray and Fertilizing, A.O. Hardee and Son, two employees, and three unidentified individuals. The lawsuit states that the identities of these unknown individuals will likely be revealed during the legal process, which promises to be thorough and detailed.

A photograph of the John Deere loader, a critical piece of evidence, is attached to the lawsuit. This loader was part of a major construction project initiated by A.O. Hardee and Son in February near Old Sanders Road, close to Little River and North Myrtle Beach. The other companies listed in the lawsuit were subcontractors on this project.

The incident in question occurred on the night of February 19, when McLean’s vehicle collided with the John Deere loader. The lawsuit alleges that the loader was illegally parked in the eastbound lane of the road, facing west, making it extremely difficult to see for oncoming traffic. It further claims that the loader had no activated lights, flagmen, or any other warning systems, significantly increasing the risk of an accident.

Adding to the complexity of the case, the lawsuit states that one of the named employees moved the loader after the crash but before law enforcement arrived. This action was allegedly taken under the direction of the employee’s boss. The estate of William McLean accuses the defendants of gross negligence and is seeking both actual and punitive damages, alongside a jury trial to bring full accountability.

This tragic accident has highlighted serious concerns about safety practices in construction zones. The loss of William McLean has prompted a legal battle aimed at ensuring such negligence does not occur again. The lawsuit emphasizes the critical need for proper safety measures and accountability in construction areas to prevent future tragedies.

As the case progresses, more details are expected to emerge, providing a clearer picture of the circumstances leading up to the fatal collision. The community, especially those near the construction project on Old Sanders Road, will be closely monitoring developments in this lawsuit.
